CSX Asking For New Trial In Solvent Case

CSX Transportation is alleging that the jury was prejudiced due to news coverage and is asking for a new trial in the case where a Corbin man won a 1.8 million award in his claim that his brain was damaged by solvents he used on his job. The article in the Courier Journal was about research that showed solvents used to clean by railroad workers in the past had shrunk the bridge of the brain, that bridge helps one side of the brain communicate with the other side. It did no reference the trial itself.

"David Klapheke, an attorney for CSX, contends that the article prejudiced the jury by containing information about the company's other solvent lawsuits and settlements that was not allowed in the trial."
