Lexington Kentucky Teenage Girl Dies After Being Trapped Under Water by a Defective Drain

A young Lexington Kentucky Girl has has died from a Brain Injury that she suffered by being held under water by a Defective Drain. Kiah Milsom was held under water by the defective drain for 20 minutes before rescue workers freed her from the drain. She died after five days in University of Kentucky Hospital.

Milsom and two other teens were swimming in a condominium swimming pool at around 4 am on July 20. The other two teens were charged with Criminal Trespassing.

Defective drains have been a source of Serious Injury and Wrongful Death in the past in many different states. Safety measures have been put in place to protect swimmers from such hazards but swimming pools and drains are still dangerous.

Tanya Clark Dies of Head Trauma After Pulaski County Kentucky Crash

Tany Clark, 32, from Indiana, died at the UK Chandler Medical Center on Tuesday from Head Injuries that she suffered in a massive Pulaski County Kentucky Car Wreck.

Clark had stopped as the car in front of her was going to turn. As she stopped a car came from behind her hitting her in the rear end where she was forced into the other lane. She was then t-boned by a SUV.

Clark was one of several that were airlifted to UK to the Chadler Medical Center. Clark's family will likley have a Civil Claim for Kentucky Wrongful Death under this set of facts against the car that hit her in the rear.

Kentucky Hit and Run Criminal Case Goes to Grand Jury in Lexington

Shannon Houser has waived his rights to a formal hearing and thus his Criminal Case will be turned over to the Fayette County Grand Jury. He is charged with Leaving the Scene of an Accident and Tampering with Physical Evidence. This is the Hit and Run Accident that claimed national news attention because the Accident led to the death of University of Kentucky Freshman, Connie Blount of Park City Utah.

The Kentucky Hit and Run Accident Case will now be heard by the Grand Jury. If they return an Indcitment then Houser could face from 1 to 5 years in Prison on the Tampering With Physical Evidence Charge as that charge is a Felony. Leaving the Scene of an Accident was a Misedemeanor but has since been signed into law as a Felony starting in July 2008.

There is no word yet if the Family of Connie Blount will file a Kentucky Wrongful Death Civil Suit. Generally, the Civil Suit comes after any Criminal Action.

Illinois Wrongful Death Lawsuit a Possibility in Case of Joe Randloph

The second case in only four days in Southern Illinois, could provoke another Illinois Wrongful Death Lawsuit. This time a teenage driver dropped a cigarette and ran head on into the car of Joe Randolph. The Illinois Auto Accident happened on Joppa Road in Massac County.

Several days earlier Ryan Rendleman was killed when a Semi Truck struck the rear of his car as he was stopped in a construction Zone.

Like the family of Rendleman, the family of Joe Randolph could assert a Lawsuit for Lost Earnings Capacity, Pain and Suffering, Medical and Funeral Bills and Loss of Love and Affection. This would be a Civil Suit.

Authorities have not decided if they will charge the teenage driver in the case of Randolph Criminally at this point.

Illinois Wrongful Death Lawsuit a Possibility in Case of Ryan Rendleman

The life of SIU Student Ryan Rendleman was cut short way too soon. A Tractor Trailer Driver that was not paying attention slammed into the back of Rendleman's car killing him in Southern Illinois.

The career of an Aspiring PhotoJournalist gone in the blink of an eye. A life taken by a Negligent Professional Driver.

An Illinois Wrongful Death Lawsuit is likely given the facts of this case. The family of Ryan Rendleman would have case against the Driver as well as the Company that he drove for while he was on duty. The Wrongful Death Claim ould be for Loss of Love and Affection, Lost Earnings Capacity, Medical and Funeral Bills and Pain and Suffering.

Family of Daniel Wood Files Kentucky Wrongful Death Lawsuit in Pendelton County Tragedy to Preserve Key Evidence

Daniel Wood died on Thursday in a Wreck between a School Bus and a Dump Truck. The Dump Truck swerved and crossed into the lane of the School Bus causing the Accident. 10 others including the driver of the Dump Truck and the School Bus were treated for what was called minor injuries.

Wood's Family filed a Kentucky Wrongful Death Lawsuit on Friday so that they could preserve key evidence from the Pendleton County Tragedy. This is a very good idea by the family because key evidence can get lost, misplaced or damaged.

The Family will be seeking money damages for Pain and Suffering, Lost Earnings Capacity, Reasonable Medical and Funeral Expense and Loss of Love and Affection. Wood was killed instantly.

Pendleton County Kentucky Accident Between a School Bus and a Dump Truck Leaves One Dead and Many Injured

An early morning collision in Pendleton County Kentucky near Falmouth killed one and sent at least a dozen, mostly children to the hospital. This Kentucky Bus and Dump Truck Wreck occurred around 7 am Local Time.

Kentucky State Police are reporting that one person has died from the Pendleton County Crash. They did not say whether it was a child or an adult.

Kentucky Wrongful Death Settlement is Reached With Family of Western Kentucky Student

There has been a settlement reached in the Kentucky Wrongful Death Case between the Family of a Western Kentucky Student and the City of Bowling Green. Click on this link to view the story that I posted at DarylTDixonLaw.com.

The City of Bowling Green and the Family of Allison Carter from Evansville Indiana have reportedly reached a $1 Million Settlement in this Kentucky Wrongful Death Claim. Carter's vehicle and the Police Car of Officer David Hall collided as Carter was attempting to pull through and intersection and Hall was responding to a Police Call without his lights and siren on.

The settlement brings the case to an end and allows the family and the Police Officer to avoid trial.

Change in Kentucky Wrongful Death Law Would Allow Spousal Consortium

A recent bill sponsored by Republican Robert Stivers could change Kentucky Wrongful Death Law.

Stivers bill would allow for Spouses of those killed in a Kentucky Wrongful Death to recover for loss of Companionship (Consortium). Kentucky is one of four states that do not allow for a Spousal Claim for Loss of Companionship in a Wrongful Death Lawsuit. Kentucky does recognize damage claims for Loss of Consortium in injury cases but not Wrongful Death Cases.

Last year a similar bill cruised throught the Democratic Kentucky House only to be thwarted by the Republican State Senate. This year a similar bill is in the House but problems with its retroactivity have left it stalled.

The source of this bill was suprising to many. However, it was spurred by the Comair Flight 5191 crash that woke up Stivers to the bills necessity.

Judge Thomas Russell Dismisses 62 Kentucky Wrongful Death Lawsuits in Harrison Yonts Case

Hon. Thomas Russell granted Motions to Dismiss for 62 Members of the Lambda Chi Fraternity at Murray State University. The lawsuits were filed by Nadia Shaheen, who was hit by a car driven by fraternity member Harrison Burgess Yonts.

The Kentucky Wrongful Death Lawsuits were filed on behalf of Shaheen against the 62 fraternity members. The Wrongful Death Case was in its Preliminary Hearing Stage when Judge Russell ordered the dismissals. He based his order on the evidence that there was no proof these particular fraternity members gave Yonts alcohol and he ruled that they did not have a duty to stop him from driving.
