      <title>Metrolink Train Collision Lawsuit</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Grieving parents of a &lt;a href="/national-news/first-lawsuit-filed-in-metrolink-train-collision.aspx?googleid=247526"&gt;Metrolink Train Collision&lt;/a&gt; Victim, Aida Magdaleno, are filing a lawsuit against the company after the operator ran a red light at 42 miles an hour, crashing into a Union Pacific freight train.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The crash was devastating. It killed 25 people while another 138 were injured. On behalf of the parents, Juvenal and Leticia Magdaleno,&lt;a href="http://www.injuryboard.com/Paul-Kiesel/"&gt; Paul Kiesel&lt;/a&gt; filed a claim against Metrolink.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;a href="http://www.injuryboard.com/Paul-Kiesel/"&gt;Kiesel&lt;/a&gt; says, &amp;ldquo;The positive train control system would have prevented her death. It would have slowed the train down and taken the human element out of it.&amp;rdquo;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The system he speaks of is rare due to the 2 billion dollar price tag, but it automatically overrides the errors made by railroad employees.&lt;/p&gt;

      <title>Man Dead After Boat Crash</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;a href="http://www.wpsdlocal6.com/news/local/story.aspx?content_id=1e83dfcb-f570-4b09-8153-b9d93c24fb7d"&gt;One man is dead and another, injured, after a boat wreck on Lake Cumberland.&lt;/a&gt;&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The man&amp;rsquo;s name was not immediately released, but he was reported to be from Indianapolis. He was pronounced dead after a catamaran rolled over during a poker run. The other man was released after a short stay in the hospital.&lt;/p&gt;

      <title>Kentucky Emergency Responders Need Greater Protection</title>
      <description>&lt;p&gt;&lt;a href="http://www.wpsdlocal6.com/mediacenter/local.aspx?videoId=11756@wpsd.dayport.com&amp;amp;navCatId=3"&gt;Illinois Governor Rod Blagojevich recently signed Shibs Law&lt;/a&gt;. This allows for greater protection for Emergency Responders in Illinois. The bill honored fallen Firerfighter James &amp;quot;Shib&amp;quot; Miller.&lt;/p&gt;
&lt;p&gt;The point that I was trying to make was that Kentucky must act quickly to enact a similar bill. We must not wait until tragedy strikes to update our laws protecting our Emergency Responders.&lt;/p&gt;
&lt;p&gt;James &amp;quot;Shib&amp;quot; Miller was killed just over one year ago on Intersate 57 in Illinois. He was responding to a Semi Tractor Trailer Fire when he was hit by a Greyhound Bus. Shib's Law now makes it possible for Emergency Responders to close down Highways and Interstates in order to ensure safety.&lt;/p&gt;
&lt;p&gt;Miller's Family fought hard to have this legislation passed. They wanted to see greater protection for Emergency Responders while they were in Harms Way. Although Miller's death left a void in their life that can never be filled, this legislation serve as a tribute to their Fallen Hero.       <title>Kentucky Drunk Driving Crash 20 Years Ago</title>
      <description>&lt;p&gt;Today marked the 20th Anniversary of the &lt;a href="http://www.courier-journal.com/apps/pbcs.dll/article?AID=/20080513/NEWS01/80513033&amp;amp;referrer=FRONTPAGECAROUSEL&amp;amp;GID=FWtZZLVMdJuOyapIKErSY2BTUcM7NbGyjaRbw4Q+t6M%3D"&gt;Kentucky Drunk Driving School Bus Accident on Interstate 71&lt;/a&gt; in Carrollton.  &lt;/p&gt;
&lt;p&gt;Click on the above link for a News Article and a Video.  The School Bus caught on fire and the children struggled to get out.  27 lost their lives in what has been known as the Worst Drunk Driving Accident in U.S. History.  &lt;/p&gt;
&lt;p&gt;The School kids were on their way back from a School Field Trip to Kings Island in Cinncinnati when they were hit by drunk driver traveling on the wrong side of Interstate 75.    &lt;/p&gt;

      <title>Illinois Train Accident Ends With Death of a Man in a Wheelchair</title>
      <description>&lt;p&gt;An &lt;a href="http://www.wpsdtv.com/news/local/story.aspx?content_id=da12dc0d-7a02-4eed-92dc-2df07f3d5213"&gt;Illinois Train Accident &lt;/a&gt;ended in tragedy on Tuesday in Carbondale.  The man was in a wheelchair when he was attempting to cross the Railroad Tracks.  &lt;/p&gt;
&lt;p&gt;Authorities say that the man attempted to cross on the side of the tracks where there was no crossing bars.  However, authorities did not release his name.  &lt;/p&gt;
&lt;p&gt;This Illinois Railroad Accident ended with the death of the man in the wheelchair.  We will update this story as we get further information. &lt;/p&gt;

      <title>Kentucky Bus Crash But Without Injury</title>
      <description>&lt;p&gt;There was another Kentucky Bus Crash, this time in the tiny Western Kentucky town of Kevil.  But this time there were no injuries and no deaths.  &lt;a href="http://bowlinggreen.injuryboard.com/wrongful-death/pendelton-county-kentucky-accident-between-a-school-bus-and-a-dump-truck-leaves-one-dead-and-many-injured.aspx?googleid=238044"&gt;Late last week a Kentucky Bus Crash killed one student in Pendleton County Kentucky. &lt;/a&gt;&lt;/p&gt;
&lt;p&gt;This &lt;a href="http://www.wpsdtv.com/news/local/story.aspx?content_id=8ad878b3-8c9a-4cf2-94ba-ad26989dbc4c"&gt;Kentucky Bus Crash&lt;/a&gt; was the result of another driver smashing into the back of the School Bus.  As you can see in the pictures this was not a regulation school bus but rather one that transported Pre School Children.  Therefore, there were seatbelts used and they may have prevented any students from being hurt.&lt;/p&gt;
&lt;p&gt;I wrote on the topic of &lt;a href="http://western-kentucky.injuryboard.com/mass-transit-accidents/pendleton-county-kentucky-bus-crash-sparks-fears-in-western-kentucky.aspx?googleid=238222"&gt;Seatbelt Safety on School Buses last week&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;Lets keep on until we get seatbelts in all Kentucky School Buses.  Leave comments here if you agree with me or have additional comments on the subject.&lt;/p&gt;

      <title>Kentucky Man Hit by Train in Critical Condition</title>
      <description>&lt;p&gt;A 19-year-old Lexington man remains in critical condition following a &lt;a href="http://www.kentucky.com/211/story/216372.html"&gt;train accident&lt;/a&gt; yesterday.&lt;/p&gt;&lt;p&gt;The man was struck by a 31-car train at 4:30 a.m., Saturday. He was on his way home from a Halloween party near Nicholasville Road, according to a close family friend.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;&lt;blockquote&gt;An engineer on the train at the time of the accident reported he saw a man jumping in and out of the train track's rail as the train was approaching. The train crew sounded a warning bell and horn, according to a company spokesman. It took quite some time to stop the 5,558-ton train.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;At this time it is unclear how fast the train was traveling but the speed limit in that area is 40 mph. &lt;/p&gt;&lt;p&gt;A family friend spoke with three residents who leave close to the tracks. None of them remember hearing the train or horn during the time of the accident.       <title>Fiery Train Derailment Caused By Bad Bolt</title>
      <description>&lt;p&gt;The CSX train &lt;a href="http://www.courier-journal.com/apps/pbcs.dll/article?AID=/20070404/ZONE10/704041526"&gt;derailment&lt;/a&gt; in Bullitt County in January was caused by a broken bolt on a freight car. The broken bolt caused the car not to steer properly and caused it to jump the track on a curve near Brooks, Ky.  The freight car is owned by a CSX customer but the railroad is responsible for the maintenance and safe operation of it. The crash forced an estimated 500 people from their homes. Some of which have yet to return. &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;"Bill Sutherland, who with his wife Lillian was displaced for 10 weeks while their home was cleaned and decontaminated, said the railroad's findings are little consolation. &lt;br /&gt;"Everything is still turned upside down," said Sutherland, who moved back in last weekend.       <title>Families Still Displaced 6 Weeks After CSX Train Wreck</title>
      <description>&lt;p&gt;Six weeks later after the train derailment in &lt;a href="http://www.courier-journal.com/apps/pbcs.dll/article?Date=20070225&amp;Category=NEWS01&amp;ArtNo=702250523&amp;SectionCat=NLETTER01&amp;Template=printart"&gt;Brooks, KY&lt;/a&gt;, more than a dozen families are still not in their homes. Some say they aren't going back. Some wonder what the appraisal of their homes will be as no one else wants to move there either. Families living in hotels, it's become the normal for fast food since there is no kitchens for some. Children missing the privacy of their own rooms. Some are asking CSX to buy their homes, they don't want to go back. One stay at home mom was 10 weeks pregnant at the time of the crash and has since miscarried. They plan to look for a new home but say they will never live close to train tracks again. CSX is facing three lawsuits filed in U.S. District Court in Louisville as a result of the derailment.
