A young Lexington Kentucky Girl has has died from a Brain Injury that she suffered by being held under water by a Defective Drain. Kiah Milsom was held under water by the defective drain for 20 minutes before rescue workers freed her from the drain. She died after five days in University of Kentucky Hospital.
Milsom and two other teens were swimming in a condominium swimming pool at around 4 am on July 20. The other two teens were charged with Criminal Trespassing.
Defective drains have been a source of Serious Injury and Wrongful Death in the past in many different states. Safety measures have been put in place to protect swimmers from such hazards but swimming pools and drains are still dangerous.

It is very disheartening to hear that the legal system is going after teens when the real irresponsibility rests with the State of Kentucky Health Department. Unfortunately, we can't sue governments and government employees are not typically held responsible for their actions. In this case, the State of Kentucky was warned numerous times in the year prior to this event that the current State code was deficient and dangerous. Had they acted, promoted, and allowed the all options afforded to all Americans under the December 2007 Virginia Graeme Baker Safety Act, then Kiah might still be alive today. Analysis of the pool in question conclusively concludes, the drain was completely unnecessary in the first place. The State mandates that all pools have sufficient water from surface skimmers, or overflows, to support all circulation. They then mandate unnecessary drains. I hope that some Attorney will finally address the root cause of this problem and rather than mandate drains in a public pool, mandate that one prove they need them. Emails sent to the state are available to anyone that wants them. When you read them, you will clearly understand that this was completely preventable.

It can be done. We don't sell gadgets or build pools in Kentucky so I am not trying to make money -- I'm trying to help save lives!The people of Kentucky must demand a safe pool environment. No one should have to die on a pool drain!!!!
