The Kentucky General Assembly passed a law in February 2004 establishing the fetal homicide crime. Now the first fetal homicide case in Jefferson County comes from a January 13th wreck with a drunken driving charge. The Mount Washington driver is accused of running a red light at Bardstown Road and Interstate 265 and hitting a vehicle in which the driver was seriously injured and lost her fetus. While charged with drunken driving he was also charged with assault, criminal mischief and disregarding a traffic light. If convicted he could be sentenced to life in prison.
