We've been building pools and pool/spa combinations in Florida for six years - ALL without drains! We worked to get the Florida Building Code to allow drain-less (100% entrapment-free)to be built. It can be done.
We don't sell gadgets or build pools in Kentucky so I am not trying to make money -- I'm trying to help save lives!

The people of Kentucky must demand a safe pool environment. No one should have to die on a pool drain!!!!

It is very disheartening to hear that the legal system is going after teens when the real irresponsibility rests with the State of Kentucky Health Department. Unfortunately, we can't sue governments and government employees are not typically held responsible for their actions.

In this case, the State of Kentucky was warned numerous times in the year prior to this event that the current State code was deficient and dangerous. Had they acted, promoted, and allowed the all options afforded to all Americans under the December 2007 Virginia Graeme Baker Safety Act, then Kiah might still be alive today. Analysis of the pool in question conclusively concludes, the drain was completely unnecessary in the first place. The State mandates that all pools have sufficient water from surface skimmers, or overflows, to support all circulation. They then mandate unnecessary drains.

I hope that some Attorney will finally address the root cause of this problem and rather than mandate drains in a public pool, mandate that one prove they need them.

Emails sent to the state are available to anyone that wants them. When you read them, you will clearly understand that this was completely preventable.

the state should also be held responsible for allowing the construction co. flag that stretch of hwy in the manner they did. that is saying that anjulating terrain played a part. i'm sure there were state inspector on that site at one time or another. not to mention, the next morning i heard there was another accident in the same place. this time the injured were only critical. but whats the worse of two evils? disabled for the rest of a life? someone needs to fix this once and for all!!!

That is a great point that you make. Depending on what the facts are, the Construction Company could be liable in this tragedy. They, like the drivers, have a duty to act with reasonable care in their actions as well as in their warnings.
